1. Use of the website and acceptance of its terms and conditions
When you access the OSEntreprendre website (“OSEntreprendre”) (the “website”), you (“You” or the “User”) accept all the terms and conditions (“Terms and Conditions”) stated below. Browsing the OSEntreprendre website and simply activating a hyperlink there constitutes a commitment on your part to comply with the aforesaid Terms and Conditions.
OSEntreprendre can modify the Terms and Conditions at any time without notice. Using the site after the modified Terms and Conditions have appeared onscreen is equivalent to accepting the new conditions. You are therefore invited to read the Terms and Conditions periodically.
2. Intellectual property
With the exception of works used under licence or hyperlinks displayed on the website, OSEntreprendre is the exclusive holder of intellectual property rights on all of the website’s content, including articles, texts, photographs, images, illustrations, audio clips, video clips, software and codes.
Without limiting the foregoing, OSEntreprendre is the exclusive holder of the trademarks on the website. The User undertakes to not use the trademarks found on the website without previous authorization in writing from OSEntreprendre. The following trademarks are the property of OSEntreprendre: “OSEntreprendre®,” “OSEntreprendre Challenge®” and “Entrepreneurship, I’m up for the Challenge!®”
In addition, OSEntreprendre may own other trademarks associated with names, words, advertising slogans, logos, drawings and other graphics that may be posted from time to time on the website.
In the event that a trademark of a third party is posted on the website via a hyperlink or some other means, this posting must not be interpreted as a “use” of the trademark under the Trade-marks Act and/or constitute a representation on the part of OSEntreprendre that would make it a company affiliated or associated with the owner of that trademark.
3. Website limited use licence
For the purposes of navigation on its website, OSEntreprendre grants the User a limited licence that permits the User to post on their computer screen or print out, download or use the HTML underpinning the website, as well as the texts, audio clips, video clips and all other content that the User may have access to, but only for non-commercial, personal or educational purposes—all subject to the condition that the User does not modify the content.
No other use of OSEntreprendre intellectual property is permissible apart from that mentioned above, unless preliminary consent to do so has been obtained from OSEntreprendre.
4. No guarantee
OSEntreprendre has designed its website for informational purposes and to receive application packages. Although OSEntreprendre compiled the information on its site with due care for its initial presentation, it is possible that some of this information may be incorrect or inaccurate. Information on the site may also have become outdated. In either case, OSEntreprendre cannot be held liable for any direct or indirect losses or damages that may ensue.
OSEntreprendre makes no representations or warranties that the server on which the website is operated is or will be free from viruses or other harmful components. OSEntreprendre reserves the right to limit access to the website when the User’s actions violate the Terms and Conditions.
7. Applicable law
The present Terms and Conditions as well as their interpretation, execution, validity and effects are subject to the laws of Québec and to any federal laws that may apply.
8. Election of domicile
The User and OSEntreprendre agree that any action, claim, procedure and legal or administrative recourse of any nature stemming directly or indirectly from the present Terms and Conditions must be introduced and heard by the court that has competence in the judicial district of Québec City, to the exclusion of all other judicial districts in the province of Québec.
